Protecting Your Rights after a Personal Injury
When you have been hurt on the road because of the carelessness or negligence of another person, you have a right to seek compensation for all your losses. The actions you take in the immediate aftermath of the accident can have a significant effect on your health and your legal rights. Here’s a guideline for protecting yourself after a wreck.
Get the Medical Attention You Need
Your first priority should always be your health and safety. If you are unable to move under your own power, or if you believe you have any injury to your neck, back or spinal cord, stay where you are. Wait until emergency medical personnel arrive and let them determine whether you should try to get up or whether they should move you to an ambulance and take you to the hospital. Remember—this is no time to be strong or heroic. It’s a time to acknowledge that you may have been seriously hurt, and that some of your injuries may not be immediately apparent.
Even if you are able to move under your own power, and can leave the scene on your own, it’s important to seek immediate medical attention, whether it’s at a hospital, an urgent care facility or your personal physician. You’ll often improve your chances of maximum recovery. You’ll reduce the risk that a defense attorney will argue that your injuries were caused by some subsequent act, or that your injuries were not that serious.
When you seek medical attention, tell the doctor everything that happened. Don’t focus on the obvious injuries—the broken leg—and neglect the subtle one—a sore back, for example. Make certain the doctor puts everything in writing.
The more information you (or someone acting on your behalf) can compile, the better. Get the names, addresses, phone numbers and other contact information from anyone involved in the accident, as well as any witnesses. Don’t rely on police officers to do this…they may only get information from the drivers.
Take pictures of everything, from the damage to all vehicles to your injuries to any skid marks to road conditions to weather conditions. You can use the camera on a phone.
Hire an Experienced Attorney
You’ll want to hire a proven motor vehicle accident lawyer as soon as possible, so that evidence can be gathered and preserved, and all necessary filings submitted in a timely manner. Your attorney can also act as your liaison with insurance adjustors, helping you get the benefits to which you are entitled.
